Spain to Shield Corruption Whistleblowers: Impact on Real Estate Trust

The Spanish Government is taking a significant step towards greater transparency and accountability with the imminent approval of a draft law designed to protect whistleblowers exposing corruption. This legislative initiative, slated for approval by the Council of Ministers, aims to safeguard employees — whether from the private sector, civil servants, or contract staff — who dare to report irregularities within their workplaces. The primary objective is to eradicate dismissal, workplace harassment, and any form of retaliation against those who act as guarantors of integrity.

To realize this protection, the proposed law will undertake a comprehensive reform of several key articles within the Workers' Statute (Estatuto de los Trabajadores). Among the articles to be modified are Article 4, pertaining to fundamental labor rights; Article 14, which regulates the probation period; Article 17, focusing on non-discrimination in labor relations; Article 53, specifying the form and effects of contract termination for objective reasons; and Article 55, referring to the effects of disciplinary dismissal. These modifications seek to establish a robust legal framework that deters retaliation and fosters an environment where reporting corrupt practices is viewed as an act of public service.
